General Terms and Conditions (GTC) B2B
Preamble
TACHOfresh GmbH (hereinafter: TACHOfresh), with its registered office in Germany, 15745 Wildau, Freiheitstraße 120, Access C, distributes hardware from various suppliers and develops and distributes software and telematics applications, as well as services in the transport and logistics environment and electronic data processing.
The following terms and conditions of delivery, service and payment apply exclusively and to all contracts, deliveries and other services, including service and consulting services provided by TACHOfresh to its commercial end customers and commercial partners (hereinafter: Customer). Accordingly, TACHOfresh ‘s customers can only be companies.
For some services, supplementary provisions may apply in addition to these General Terms and Conditions (“Terms of Use”). The services of TACHOfresh may also be specified by further rules of conduct or guidelines for certain features or offers. In case of contradictions in the TACHOfresh regulations, the more specific standards always apply.
This means a displacement from the general to the specific, i.e. in the presence of such codification – GTC, condition of use, rule of conduct/guideline.
All contractual components such as the GTC and/or Terms of Use and/or Additional Provisions, Rules of Conduct or Guidelines form a legal unit which takes effect vis-Ã -vis the customer in its entirety.
These GTC apply exclusively. Contractual terms and conditions of the customer shall not apply. Counter-confirmations of the customer with reference to his own terms and conditions are expressly contradicted.

All ancillary agreements to contractual agreements must be in writing in order to be effective. This also applies to changes or cancellation of individual provisions of these GTC.
